Appeals Court Upholds West Hollywood’s Ban on Cat Declawing

The California Court of Appeals rules that cities can legally prohibit the declawing of cats without violating state law.

California’s Court of Appeals ruled that cities can legally ban cat declawing without violating state law.
The California Court of Appeals has ruled in favor to uphold West Hollywood’s ban on cat declawing. In a 2-1 vote, the Court of Appeals determined that cities can legally prohibit cat declawing without violating state law.

The West Hollywood ordinance, which was passed in 2003, makes it a crime to perform declawing within city limits, except for therapeutic purposes such as removal of infected or injured tissue. The ordinance declares that the procedure causes “unnecessary pain, anguish and permanent disability.”

The California Veterinary Medical Association filed suit against West Hollywood in 2005, stating that the city had no authority to regulate the medical practices of veterinarians. Shortly after, the ordinance was overturned, which CVMA said confirmed its “assertion that local ordinances may not infringe on licensed professionals’ state-granted rights to practice within the scope of their licenses.”

However, this recent ruling by the Court of Appeals determines that the city’s ordinance is not preempted by state law, thus making the ban legal and enforceable. It finds that a city may regulate actions that it considers inhumane, as long as it does not prohibit veterinary procedures that state law expressly allows.

The declawing of wild and exotic cats is already illegal in California.

In view of the fact that many cats will be killed everyday because there are no homes in which to place them .I should think that the primary concern would be to find loving homes. I think most cats would opt for declawing rather than death. Many areas have predators that would kill cats if they ever got outside.

Absolutely right! And now we have the possibility of bans in Santa Monica, Los Angeles and San Francisco, it can't happen soon enough for me. People of the USA, in every state, city and town, very soon you will no longer be allowed to amputate your cat's toe ends,you'll either live with them as we do in more enlightened countries, or you will have to buy yourselves a soft furry toy instead of a graceful living creature.

This is absolutely laughable. Thank God most of the country is still sane.

My two cats are declawed and live perfectly comfortable, happy lives. And I will continue to declaw any cats I adopt in the future.

Oh yeah CA, pass some more laws. Don't you guys have some taxes to increase? Not that I agree with declawing cats, but I agree even less with too much government interference.
